dc.description.abstractRights relating to children and adolescents consolidation occurred in Brazil with the institutionalization of guarantees, both through the Federal Constitution enacted in 1988 as by the entry into force of the Child and Adolescent Statute. However, there were no significant changes in the procedural scope, remaining people in development situation, regarding their hearing, receiving equal treatment in the lawsuits they are victims and/or witnesses, as any adult involved. Searching for an alternative way to the traditional, that obeys the contradictory and the wide defense and decreased institutional violence practiced by state representatives against children and adolescents, arises the Testimony Without Damage implantation proposal in the Brazilian judicial system. The project is focused on the verification of illicit that involve children and adolescents, considering the difficult construction evidentiary owing to the circumstances that usually occur: on the sly, with no presence of witnesses and, at times, without physical traces. Intended, among other things, reducing revictimization, of the serious indications of impunity, besides reducing the justified fear of criminal condemnation of innocents. The idea arose in Porto Alegre city, mediated by the Law Judge José Antonio Cezar Daltoé, and its dynamic comprises three steps: initial reception, the testimony or hearing and final reception/forwards. It is about a practice by which the infant involved have taken his testimony at a room specially designed for this purpose, by a qualified professional designated by the judicial authority - Psychologist or Social Worker - and recorded by audiovisual means. This study aims to understanding what is the Testimony Without Damage and what are the implications arising from its use. For this, it was used the deductive method, as it started from the historical analysis of the children and adolescents protection in the Brazilian law. After, it was approached the contemporary legal system of persons hearing under development. Were used, also, historical and monographic methods, seeking to investigate the origins of the inherent rights to children and adolescents and analyze if these rights have been fully guaranteed, as well as if the practice of Testimony Without Damage is being suitable for the purpose it proposes. At the end of the study, it was realized that, even if it does not involve an ideal method, the Testimony Without Damage has been shown concretely more efficient on the elucidation of facts and in the respect to the victim/witness, adolescent or child, reducing the heavy justice system impact, its rites and its formalities.eng

dc.description.resumoA consolidação dos direitos relativos às crianças e aos adolescentes no Brasil se deu com a institucionalização das garantias, tanto através da Constituição Federal promulgada em 1988 quanto pela entrada em vigor do Estatuto da Criança e do Adolescente. Entretanto, não houve significativas alterações no âmbito processual, permanecendo as pessoas em situação de desenvolvimento, no que diz respeito à sua oitiva, recebendo idêntico tratamento nas ações em que são vítimas e/ou testemunhas, como qualquer adulto envolvido. Em busca de uma forma alternativa à tradicional, que obedecesse ao contraditório e a ampla defesa e diminuísse a violência institucional praticada pelos próprios representantes do Estado contra crianças e adolescentes, surge a proposta de implantação do Depoimento Sem Dano no aparelho judicial brasileiro. O projeto é voltado à apuração de ilícitos que envolvam crianças e adolescentes, tendo em vista a difícil construção probatória em virtude das circunstâncias em que geralmente ocorrem: às escondidas, sem presença de testemunhas e, por vezes, sem vestígios físicos. Pretende, entre outros, a redução da revitimização, dos graves índices de impunidade, além de reduzir o fundado temor da condenação criminal de inocentes. A ideia nasceu na Cidade de Porto Alegre, mediada pelo Juiz de Direito José Antônio Daltoé Cezar, e sua dinâmica compreende três etapas: o acolhimento inicial; o depoimento ou inquirição e o acolhimento final/encaminhamentos. Trata-se de uma prática através da qual o infante envolvido tem tomado o seu depoimento em sala especialmente projetada para tal fim, por intermédio de um profissional capacitado designado pela autoridade judiciária – Psicólogo ou Assistente Social - e registrado por meio audiovisual. O presente trabalho objetiva a compreensão do que é o Depoimento Sem Dano e quais as implicações decorrentes do seu uso. Para tanto, foi utilizado o método dedutivo, visto que se partiu da análise histórica da proteção da criança e do adolescente no ordenamento pátrio. Abordou-se, após, o contemporâneo sistema legal de inquirição das pessoas em desenvolvimento. Utilizaram-se, ainda, os métodos histórico e monográfico, buscando pesquisar as raízes dos direitos inerentes às crianças e aos adolescentes e analisar se esses direitos vêm sendo integralmente garantidos, bem como se a prática do Depoimento Sem Dano está sendo adequada ao fim que propõe. Ao final do trabalho, percebeu-se que, ainda que não se trate de um método ideal, o Depoimento Sem Dano tem se mostrado concretamente mais eficiente na elucidação dos fatos e no respeito a vítima/testemunha, adolescente ou criança, diminuindo o impacto do pesado sistema de justiça, de seus ritos e de suas formalidades.por
