Políticas públicas de acolhida para imigrantes e a aplicabilidade do artigo 6º da constituição federal

Abstract

The human being crosses borders looking for better conditions since always, voluntarily or not. Therefore, migration’s a natural process and a human right. So, whenever a person finds herself in an unknown place, she ends up facing several difficulties related to the new life, such as in the aspects of housing, subsistence, xenophobia and the social integration in general. The sphere of a person’s fundamental rights subjected to the immigration process is affected and she becomes vulnerable. Then, through the deductive method of approach and bibliographic review as technique, the goal is to investigate how’s the Public Power acting in relation to his constitutional duty in creation specific public policies for immigrants who live in Brazil, since the State can’t choose to implement them or not. This is because immigrants’s demands should be answered, as well as it’s not possible to leave helpless a contingent holder of fundamental rights foreseen in the Federal Constitution. Thereby, this research begins with an exposition of the fundamental rights’s history and the conceptual aspects of public policy. Subsequently, the policies’s aspects of the reception are presented, which is essential to the promotion of equity; also evaluating of the Federal Public Ministry’s performance in order to make the Executive accomplish his duty to implement public policies. Finally, there’s an overview of the existing brazilian policies and the institutions responsible for their implementation, emphasizing that still there are few policies, also much to be done, even if they are useful and very helpful to immigrants.
