dc.description.abstract | This work holds to the legal analysis of the urban instrument called
Development Rights Transfer – DRT, as a way of protecting the built cultural heritage
in the legal system of the city of Santa Maria/RS. The federal law 10.257 from July
10th
, 2001, known as the city statute, is responsible for the general rules of Urban
Policy in Brazil. Its text mentions several times a concern with the protection of the
cultural heritage, through guidelines or even instruments used for this purpose. The
Development Rights Transfer is one of those instruments, which has, among other
purposes, the preservation of the cultural interest property. It is about the possibility
of alienation or exercising in another place of the idle constructive potential of that
property. However, in order to make the municipalities use the instrument, they need
to have the Master Plan and edit the city law, regulating the transfer. As the city of
Santa Maria has the Environmental and Urban Development in its Master Plan, it
contains a projected utilization of DRT as a urban instrument, but until now it has not
been edited anything about the topic in the city statute, making its use impossible.
The study was developed in three chapters, focused on the final result, consisted in
the draft project for a specific law to the DRT in Santa Maria/RS. Initially, the analysis
was developed on the built cultural heritage and on the DRT's instrument, with
conceptual and historical approaches about the topic, emphasizing the municipal
public policies to the cultural heritage, the housing market and the challenges in the
preservation, as well as the social function and the cultural interest of the property.
Then, DRT was investigated in other city statutes and the case of Santa Maria/RS,
with a survey about the legal protection to the built cultural heritage of the city and
the analysis of the urban law in the city. Finally, legal considerations were made on
the feasibility of using the instrument in Santa Maria/RS, approaching some
controversial issues about DRT, the usage of the instrument in Santa Maria/RS and
the mainly points to be noticed in the text of the law. Once the analysis was done, it is
proposed a draft project on the regulatory specific law of the Development Rights
Transfer of the city, in order to incorporate the instrument to the public policies of
management and the protection to the cultural heritage, extremely important so that it
can be ensured the economic sustainability to the cultural good. | eng |

dc.description.resumo | Esta dissertação detém-se à análise jurídica do instrumento urbanístico
denominado Transferência do Direito de Construir – a TDC, como forma de proteção
ao patrimônio cultural edificado no ordenamento jurídico do Município de Santa
Maria/RS. A Lei Federal 10.257 de 10 de julho de 2001, conhecida como Estatuto da
Cidade, é a responsável pelas normas gerais da Política Urbana no Brasil. Seu texto
refere, por diversas vezes, a preocupação com a proteção do patrimônio cultural,
seja por meio das diretrizes ou mesmo por instrumentos utilizados para esse fim. A
Transferência do Direito de Construir é um desses instrumentos, que possui, entre
outras finalidades, a de preservação do imóvel de interesse cultural. Trata-se da
possibilidade de alienação ou de exercício em outro local do potencial construtivo
ocioso naquele imóvel. No entanto, para que os municípios se utilizem do
instrumento, precisam possuir Plano Diretor e editar Lei Municipal regulamentando a
transferência. Como o Município de Santa Maria possui em seu Plano Diretor de
Desenvolvimento Urbano e Ambiental previsão de utilização da TDC como um
instrumento urbanístico, e até hoje não foi editada lei municipal específica sobre o
tema, inviabilizando a sua utilização, desenvolveu-se o estudo em três capítulos
voltados para o resultado final, o produto consistente na minuta de projeto de lei
específico para a TDC em Santa Maria/RS. Inicialmente, as análises se
desenvolveram sobre o patrimônio cultural edificado e o instrumento da TDC, com
abordagens conceituais e históricas sobre o assunto, destaque para as políticas
públicas municipais para o patrimônio cultural, o mercado imobiliário e os desafios
na preservação, assim como a função social da propriedade e a propriedade de
interesse cultural. Em seguida, foi investigada a TDC em outras legislações
municipais e o caso de Santa Maria/RS com o levantamento sobre a proteção legal
ao patrimônio cultural edificado da cidade e a análise da legislação urbanística do
município. Por fim, são feitas as considerações jurídicas acerca da viabilidade da
utilização do instrumento em Santa Maria/RS, com a abordagem de algumas
questões controvertidas sobre a TDC, a utilização do instrumento em Santa Maria e
os pontos fundamentais a serem observados na redação da lei. Feitas tais análises,
propõe-se a minuta de projeto de legislação específica regulamentadora da
Transferência do Direito de Construir para o município de Santa Maria, a fim de que
o instrumento possa ser incorporado às políticas públicas de gestão e proteção do
patrimônio cultural, extremamente importante para que se possa garantir a
sustentabilidade econômica ao bem cultural. | por |
