dc.description.abstractIncreasingly constant, the effective protection of human rights has been a concern of jurists and scholars in the field. Since the proliferation of human rights international treaties, the signatory States, in order to meet Human Rights International Law guidelines and principles, have been adapting their internal legal, giving the new standards brought by human rights treaties considerable relevance. Thus, these standards started gaining a supra-legal, a constitutional or even a supra-constitutional level, which means, in this last case, above any other internal law of the country. In Brazil, the hierarchical question about human right conventions, although it seems pretty solved, it is not pacified. Apparently, the hierarchical level of these documents was defined, in an unprecedented way, in the judgment of the Appeal Recurso Extraordinário n. 466.343/SP by the Brazilian Federal Supreme Court, in which the thesis of supra-legality but infra-constitutionality, in a fierce legal dispute with the thesis of constitutionality, would have been the winner with the most votes. And, even with this change of position by the Court, the wide doctrine is critic when it asserts that the matching of human rights international treaties and constitutional rules is provided by the correct interpretation of the Article 5, paragraphs 1 and 2 together with other rules and principles from the Constitution of 1988, and that the thesis of constitutionality is the one that should prevail. Thus, the study aimed to verify if the thesis of supra-legality was the one winning the argument at the trial, and also to verify the legal possibility of adopting the thesis of constitutionality. It was proceeded, therefore, using the dialectical method of approach, and using the historic, monographic and comparative procedures, an analysis of the evolution of human rights and international treaties, as well as the problem of hierarchical level in Brazil and an analysis of the votes in the trial 466.343 and, at the end, to an analysis of the votes in the RE 466.343 trial, from which it follows that there was no current supremacy of the thesis of supra-legality in Plenary. Finally, when analyzing the thesis of constitutionality and its aspects, it was based primarily on doctrine, that this thesis has constitutional provisions and should prevail over other theses, and also that the Supreme Court should evolve further in refers to the theme.eng

dc.description.resumoDe forma cada vez mais constante, a efetiva proteção dos direitos humanos vem sendo preocupação de juristas e estudiosos da área. Desde a proliferação de tratados internacionais de direitos humanos, os Estados signatários destes documentos, a fim de atender às novas orientações e princípios do Direito Internacional dos Direitos Humanos, vêm adequando seus ordenamentos jurídicos, dando às normas trazidas por esses tratados considerável relevância. Deste modo, estas normas passaram a ganhar nível supralegal, constitucional ou até mesmo supranacional, acima de qualquer lei interna do país. No Brasil, a questão hierárquica dos tratados de direitos humanos, ainda que pareça resolvida, não está pacificada. Aparentemente, o nível hierárquico destes documentos foi definido, de forma inédita, no julgamento do Recurso Extraordinário 466.343/SP pelo Supremo Tribunal Federal, no qual a tese da supralegalidade mas infraconstitucionalidade, em acirrada disputa jurídica com a tese de constitucionalidade, teria saído vencedora com maioria de votos. E, mesmo diante da mudança de posicionamento pela Corte Suprema, a larga doutrina é crítica em afirmar que a equiparação dos tratados de direitos humanos às normas constitucionais é prevista pela interpretação do artigo 5º, parágrafos 1º e 2º, em conjuntos com demais dispositivos e princípios da Constituição Federal, sendo a tese da constitucionalidade a que deve prevalecer. Deste modo, o trabalho teve como objetivo verificar se a tese da supralegalidade realmente foi a tese vencedora durante o julgamento, bem como verificar a possibilidade jurídica de adoção da corrente da constitucionalidade. Realizou-se, portanto, utilizando-se do método dialético de abordagem, e através dos procedimentos histórico, monográfico e comparativo, uma análise da evolução dos direitos humanos e dos tratados internacionais, partindo-se, após, para a problemática do nível hierárquico destes no Brasil e à análise dos votos do julgamento do RE 466.343, a partir do que se conclui que não houve supremacia da corrente da supralegalidade em Plenário. Por fim, ao ser analisada a aplicabilidade da tese de constitucionalidade e de seus aspectos, verificou-se, com base principalmente na doutrina, que esta possui fundamento nos dispositivos constitucionais, devendo prevalecer sobre as demais teses e necessitando o Supremo evoluir ainda mais no que se refere à temática.por
