dc.description.abstract | Humanity's seek for knowledge has allowed us to conclude that, regardless of differences, all
individuals belong to the same species, so that all are worthy of the same respect and dignity.
Despite the theoretical construction in favor of respect for all there are numerous discriminatory
practices, stands out the Universal Declaration of Human Rights, internationally, and
nationally, the enactment of 1988 Constitution, until current days. Even worse than hate
speeches are, since they are intended to violate the dignity of human groups with particular
characteristics and to spread fear and terror, as they boost violence against the victim group.
Hateful practices are nothing new, but they take on new shape with their spread on the Internet,
especially on social networks, due to their ability to diffusely reach victims and attract
followers. Faced with this situation, it is necessary that the State, by means of Criminal Law,
represses such conducts. Thus, it is pertinent to question: if we consider the main international
treaties and the doctrine, what are the limits on the understanding of hate speech as a constitutive
criminal offense and to what extent do they contrast (or not) with the jurisprudence reality of
the Supreme Courts of Brazil? This dissertation delves into to answer this question. A concept
and different classifications of hate speech were unraveled, distinguishing it from prejudiced
speech. It was verified that hate speech is not included in the sphere of protection of the right
to freedom of opinion and expression and besides, in Brazil, there is no criminal type that
criminalizes, specifically, the issuance of hate speech, but it is possible to punish some of its
manifestations through the crime of incitement and apology for the crime. Finally, it was
concluded, when investigating the criminal jurisprudence of the Supreme Courts of Brazil,
which, until the present, there is no trial where they have faced in depth issues related to the
criminal illegality of hate speech published on social networks. As for the basic theory, the
analytical theory is used. As for the primary approach method, we used the deductive. As for
the secondary approach methods (procedural methods), monograph and statistic were chosen.
Finally, as for the research techniques, we operated with the documentary and the bibliographic,
as well as direct observation, systematic, non-participatory and individual. The dissertation was

dc.description.resumo | A busca da humanidade por conhecimento permitiu concluir que, independentemente de
diferenças, todos os indivíduos são pertencentes à mesma espécie, de modo que todos são
merecedores do mesmo respeito e dignidade. Não obstante a construção teórica a favor do
respeito de todos por todos, onde se destaca, internacionalmente, a Declaração Universal dos
Direitos Humanos, e, nacionalmente, a promulgação da Constituição de 1988, até os dias
correntes, há inúmeras práticas discriminatórias. Pior que elas, são os discursos de ódio, visto
que se destinam a violar a dignidade de grupos humanos com características particularizadoras
e a espalhar o medo e o terror, na medida em que estimulam a violência contra o grupo vítima.
As práticas odientas não são novidade, mas ganham novos contornos com sua propagação na
internet, sobretudo nas redes sociais, pela capacidade de atingir difusamente as vítimas e de
conquistar adeptos. Diante deste quadro, faz-se necessário que o Estado, por meio do Direito
Penal, reprima tais condutas. Assim, é pertinente questionar: a considerar os principais tratados
internacionais e a doutrina, quais são os limites de entendimento do discurso de ódio como
configurador de ilícito penal e em que medida contrastam (ou não) com a realidade
jurisprudencial das Cortes Supremas do Brasil? Para responder este questionamento,
desenvolveu-se a presente dissertação. Conseguiu-se deslindar um conceito e diferentes
classificações aos discursos de ódio, distinguindo-o do discurso preconceituoso. Observou-se
que o discurso odiento não faz parte do âmbito de proteção do direito de liberdade de expressão
e que, no Brasil, inexiste tipo penal que criminalize, especificamente, a emissão de discurso de
ódio, sendo, porém, possível punir algumas de suas modalidades por meio do crime de incitação
e apologia ao crime. Por fim, concluiu-se, ao averiguar a jurisprudência criminal das Cortes
Supremas do Brasil, que, até o presente, inexiste julgado onde estas tenham enfrentado com
profundidade questões atinentes à ilicitude penal de discursos de ódio publicados em redes
sociais. Quanto à teoria de base, faz-se uso da teoria analítica. No que se refere ao método de
abordagem primário, utilizou-se o dedutivo. No que tange aos métodos de abordagem
secundário (métodos de procedimento), escolheu-se o monográfico e o estatístico. Por fim,
quanto às técnicas de pesquisa, operou-se com a documental e a bibliográfica, bem como
observação direta, sistemática, não participativa e individual. A dissertação foi dividida em dois
