dc.description.abstract | Contemporary society has incorporated the use of information technologies in its daily life, organizing itself in a network. This engineering has a global reach, since all individuals are interconnected politically, socially and economically, and from this reality, new issues arise that must be legally protected. Among these emerging rights are those inherent in the use of the world wide computer network, a space in which users seek to establish relationships, whether personal, business and / or informational. This new reality has strong social, political and legal impacts, specifically those arising from the use of data from network users to direct their navigation. Thus, based on this reality, the following questions arise: Does the direction of navigation on the world wide web, based on user data collection, undermine human rights freedom of navigation and, consequently, free information and self-determination? And what are the consequences of this direction for contemporary democracies? Thus, the present dissertation aims to analyze the virtual environment in order to verify if and how the limitation of individual freedom affects fair and democratic social organization. From the perspective of egalitarian liberalism, the present research seeks in the precepts of global justice the categories to analyze such phenomenon. To develop the present work, the deductive approach method was developed, developed on a dialectical reasoning. Initially, the moral and legal foundations that allow us to affirm that free internet browsing are an emerging right required for global justice and fundamental for the development of democracy were verified. In a second moment, the architecture of the worldwide computer network was studied through the identification of the actors inserted in this environment, their interests and practices that collaborate with the conditioning of the virtual experience of the user, which makes the internet an unequal environment regarding the distribution of information. freedoms. Finally, case studies of the US presidential elections in 2016 and Brazil in 2018 were conducted, which showed that the internet is an injustice instrument, where the individual user's freedom is limited in such a way as to reflect on public freedoms, especially in the direct exercise of democracy, suffrage. | eng |

dc.description.resumo | A sociedade contemporânea passou a incorporar o uso de tecnologias de informação no seu cotidiano, organizando-se em rede. Esta engenharia tem um alcance global, visto que todos os indivíduos estão interligados política, social e economicamente, e, desta realidade, surgem novas questões que devem ser juridicamente tuteladas. Dentre estes direitos emergentes estão aqueles inerentes ao uso da rede mundial de computadores, espaço no qual os usuários buscam firmar relações, sejam elas pessoais, negocias e/ou informacionais. Esta nova realidade tem fortes impactos sociais, políticos e jurídicos, especificamente aqueles advindos da utilização dos dados dos usuários da rede no direcionamento de sua navegação. Assim, com base nesta realidade, surgem os seguintes questionamentos: o direcionamento da navegação na rede mundial de computadores, baseado na coleta de dados dos usuários, atenta contra os direitos humanos a liberdade de navegação e, consequentemente, a livre informação e autodeterminação? E quais os reflexos desse direcionamento para as democracias contemporâneas? Assim, a presente dissertação tem como objetivo analisar, criticamente, o meio virtual, a fim de verificar “se” e “como” a limitação da liberdade individual afeta a organização social justa e democrática. A partir da perspectiva do liberalismo igualitário, a presente pesquisa busca nos preceitos da justiça global as categorias para analisar tal fenômeno. Para desenvolver o presente trabalho, foi utilizado o método de abordagem dedutivo, desenvolvido sobre um raciocínio dialético. Inicialmente, foram verificados os fundamentos morais e jurídicos que permitam afirmar que a livre navegação na internet é um direito emergente exigido para a justiça global e fundamental para o desenvolvimento da democracia. Em um segundo momento foi estudada a arquitetura da rede mundial de computadores através da identificação dos atores inseridos neste meio, seus interesses e práticas empreendidas que colaborem com o condicionamento da experiência virtual do usuário, o que torna a internet um ambiente desigual quanto a distribuição das liberdades. Por fim, foram realizados estudos de casos das eleições presidenciais dos EUA em 2016 e do Brasil em 2018, as quais evidenciaram que a internet é um instrumento de injustiça, onde a liberdade individual do usuário é limitada de tal modo que gera reflexos nas liberdades públicas, em especial no exercício direto da democracia, o sufrágio. | por |
