dc.description.abstract | The general objective of the article is to contextualize the main difficulties for the implementation of public policies and guidelines that already exist in the legal system of health care for the LGBTQ+ population deprived of liberty in the Brazilian prison system. To achieve this objective, a bibliographic review of the narrative type was chosen, with this a survey was carried out through theoretical foundations and primary sources were sought to discuss the topic. Initially, it is important to mention that the LGBTQ+ population is a preferential victim of social marginalization, discrimination and violence, often leading to the loss of the entire family and social support network and the difficulty of entering the formal job market. It is concluded that it is necessary to build new models of prison units or care strategies, which seek to alleviate the overcrowding system and solve some other problems, such as lack of medical care, hygiene, food and allow the individualization of punishment according to the needs of each subject, advocating the guarantees provided for in the Brazilian Penal Execution Law. | eng |

dc.description.resumo | O objetivo geral do artigo é contextualizar sobre as principais dificuldades para implementação das políticas públicas e diretrizes já existentes no ordenamento jurídico de atenção a saúde da população LGBTQ+ privada de liberdade no sistema prisional brasileiro. Para atingir tal objetivo, optou-se por uma revisão bibliográfica do tipo narrativa, com isso foi realizado um levantamento mediante fundamentação teórica e procurou-se fontes primárias para dialogar sobre o tema. Inicialmente é importantes mencionar que a população LGBTQ+ é vítima preferencial de marginalização social, discriminação e violência, levando muitas vezes à perda de toda a rede de apoio familiar e social e à dificuldade de inserção no mercado formal de trabalho. Conclui-se que se faz necessário a construção de novos modelos de unidade prisional ou estratégias de cuidado, que busquem amenizar o sistema de superlotação e solucionar alguns outros problemas, como falta de assistência médica, higiene, alimentação e possibilitar a individualização de pena conforme as necessidades de cada sujeito, preconizando as garantias previstas na Lei de Execução Penal brasileira. | por |
