dc.description.abstract | The acquisition of land by foreign investors has been debated by several educational
institutions and by Brazilian government agencies. The debate involves the effects of this
practice, the risks it entails or the benefits it could bring to the country, which has been
influencing legislators to rethink the Brazilian legal framework that governs the matter. As a
result of this recent debate, the academic literature has been using the term land grabbing to
encompass the forms of land appropriation by foreign investors around the world, since it
presupposes different types of control over land: acquisition, lease, possession, merger of
companies, investment in capital shares, investment funds, appropriation of natural resources,
etc. Brazil, as a developing country with an extensive territorial dimension and capacity to
expand the agricultural frontier, has been targeted by foreign investors from different origins.
As a result, the present work aims to analyze the occurrence of the phenomenon of
foreignization of land in Brazil, in order to identify the areas of Brazilian land that are
currently registered under the possession or ownership of legal entities composed of foreign
capital and the destination productive given to them. From the analysis of data made available
by the Instituto Nacional de Colonização e Reforma Agrária – INCRA, it was possible to
identify that legal entities with foreign capital have land areas in almost all states of the
federation and that the main productive destination declared by investors is reforestation,
followed by permanent agriculture and livestock, and it was also identified that there are
Environmental Conservation Units owned by foreign legal entities in the country. It was also
possible to demonstrate the amount of hectares acquired by foreign companies in each
Brazilian state and some transactions carried out that may have ignored legal limitations. In
the end, it was concluded that there are weaknesses in the database provided by INCRA and
that foreign investors seek the country in order to produce on their land. | eng |

dc.description.resumo | A aquisição de terras por investidores estrangeiros vem sendo debatida por diversas
instituições de ensino e por órgãos do governo brasileiro. O debate envolve os efeitos dessa
prática, os riscos que ela acarreta ou os benefícios que poderia trazer para o país, o que vem
influenciando legisladores a repensar a estrutura legal brasileira que disciplina a matéria. Em
decorrência desse recente debate, a literatura acadêmica vem utilizando o termo land
grabbing para englobar as formas de apropriação de terras por investidores estrangeiros no
mundo todo, uma vez que ela pressupõe diversos tipos de controle sobre terras: aquisição,
arrendamento, posse, fusão de empresas, investimento em quotas capitais, fundos de
investimento, apropriação de recursos naturais etc. O Brasil, por ser um país em
desenvolvimento e com extensa dimensão territorial e capacidade de expansão da fronteira
agrícola, vem sendo visado por investidores estrangeiros de diversas origens. Em razão disso,
o presente trabalho objetiva analisar a ocorrência do fenômeno da estrangeirização de terras
no Brasil, a fim de identificar as áreas de terras brasileiras que atualmente encontram-se
registradas sob a posse ou propriedade de pessoas jurídicas compostas por capital estrangeiro
e a destinação produtiva dada a elas. A partir da análise de dados disponibilizados pelo
Instituto Nacional de Colonização e Reforma Agrária – INCRA foi possível identificar que
pessoas jurídicas de capital estrangeiro possuem áreas de terras em quase todos os estados da
federação e que a principal destinação produtiva declarada pelos investidores é o
reflorestamento, seguida pela agricultura permanente e pela pecuária, tendo sido identificado,
ainda, que há Unidades de Conservação Ambiental sob a propriedade de pessoas jurídicas
estrangeiras no país. Também foi possível demonstrar o montante de hectares adquiridos por
empresas estrangeiras em cada estado brasileiro e algumas transações efetivadas que podem
ter ignorado as limitações legais. Ao final, concluiu-se que há fragilidades no banco de dados
disponibilizado pelo INCRA e que os investidores estrangeiros buscam o país com o intuito
de produzir em suas terras. | por |
