dc.description.abstract | The judiciary system has been challenged in its effectiveness to provide legal protection in
regard to fundamental rights and constitutional principles, what conflict with the rationalist
paradigm of the process, emerging a crisis situation. The emergence of the technological
phenomenon, in the context of the networked society, reinforces this crisis through expansion
of new tier of rights and judicial procedures in today’s society, antagonizing the legitimacy of
the judge in the exercise and protection of constitutional foundations, a situation that
exacerbates the difficulties in implementation of a appropriate due process considering the
democratic rule of law. In response to the difficulties of conventional legal process, new
technological legal designs are created, more specifically implemented by technological
alternative systems or alternative extrajudicial means. This study proposes to reflect on the
impacts, limits and possibilities in the legal system and the limits of new alternative methods
of justice. Starting from the theoretical premise of the Brazilian jurisdiction crisis, sought to
understand the application of technology in the conflict resolution system and the challenges
created by the procedural technological turn to answer the question of what extent the
technological means of extrajudicialization affect the realization of rights. To explore this
matter, the work elaborated as research problem: to what extent does the movement of
technological exrtajudicialization of justice adequately respond to overcoming the crisis of
jurisdiction, promoting the exercise of rights in an accessible and democratic way? The
general objective is to investigate the impact of extrajudicialization through technologies in
the context of the jurisdiction crisis, exploring its restrictions and potential in the search for
equitable, easily accessible and democratic justice, observing the impact of the procedural
technological turn. The study has as its theoretical and legal basis the theory of the
jurisdictional crisis, mainly through the developments of Ovídio Baptista da Silva. The
research used the phenomenological approach method. The bibliographic method was used as
a method of procedure, instrumented by documentary and bibliographic analysis techniques
through records, simple and expanded summaries. Finally, it was concluded that the state of
the jurisdiction crisis, based on the rationalist paradigm, can be overcome, although partially,
through restructuring the procedural law to extrajudicial means, allowing technological
instruments to have an architecture oriented to the integrity of fundamental rights indicated by
constitutional procedural principles in order to give concreteness to rights, without the capture
of the system of protection of rights by sectors of interest. | eng |

dc.description.resumo | O processo jurisdicional enfrenta desafios na adequação aos direitos fundamentais e na
efetividade dos princípios constitucionais, que entram em conflito com o paradigma
racionalista do processo, gerando a situação de crise. O advento do fenômeno da revolução
tecnológica, no contexto da sociedade em rede, reforça esta crise decorrente expansão de
novos direitos e pela juridização na sociedade, impondo uma objeção significativa à
legitimidade do estado-juiz no exercício e proteção de fundamentos constitucionais, o que
agrava as dificuldades de implementação de um processo adequado ao Estado Democrático de
Direito. Como resposta às dificuldades da tutela convencional de direitos, são criados novos
designs jurídicos, instrumentos mais especificamente por sistemas tecnológicos alternativos,
para concretizar direitos. O presente estudo tem como propósito refletir sobre os impactos,
limitações e possibilidades no ordenamento jurídico e os desafios dos novos métodos
alternativos de justiça. Partindo da premissa teórica da crise da jurisdição brasileira, busca-se
compreender a aplicação da tecnologia no sistema de resolução de conflitos e os desafios
impostos pela revolução tecnológica processual para responder à pergunta elaborada como
problema de pesquisa: “em que medida o movimento de extrajudicialização tecnológico da
justiça responde adequadamente a superação da crise da jurisdição, promovendo o exercício
de direitos de forma acessível e democrática?”. O estudo tem como objetivo geral investigar o
impacto da extrajudicialização por meio de tecnologias no contexto da crise na jurisdição,
explorando suas restrições e potenciais na busca por uma justiça equitativa, de fácil acesso e
democrática, e observar o impacto da virada tecnológica processual. Foi eleito como
embasamento teórico e jurídico a teoria da crise da jurisdição, principalmente nos estudos de
Ovídio Baptista da silva. A pesquisa utiliza-se do método de abordagem o fenomenológico.
Como método de procedimento utilizou-se o bibliográfico, instrumentalizado por técnica de
análise documental e bibliográfica através de fichamentos, resumos simples e expandidos. Em
conclusão, com fundamento nos estudos feitos é possível superar, ao menos parcialmente, o
estado de crise por meio da reestruturação da jurisdição para estabelecer um direito
procedimental extrajudicial. Isso permite que instrumentos tecnológicos tenham uma
arquitetura orientada para a integridade de direitos fundamentais indicados por princípios
processuais constitucionais, a fim de dar concretude a esses direitos, sem que o sistema de
tutela de direitos seja capturado por interesses alheios à comunidade nacional. | por |
