Inteligência artificial e o direito à privacidade: navegando pelos desafios regulatórios no Brasil
Abstract
Este estudo analisa o impacto da Inteligência Artificial (IA) sobre a privacidade no Brasil,
concentrando-se no substitutivo dos Projetos de Lei nº 5.051 de 2019, nº 21 de 2020 e nº 872
de 2021. Com o avanço acelerado da IA, que possui capacidades de aprendizado e autonomia,
surgem desafios sem precedentes para a proteção da privacidade, particularmente no ambiente
digital. O objetivo é compreender como as práticas de coleta, análise e uso de dados por
sistemas de IA influenciam a privacidade e exploram caminhos para um marco regulatório
equilibrado e eficaz. Metodologicamente, o trabalho adota uma abordagem qualitativa, com
análise de conteúdo legislativo e bibliográfico, e utiliza estudo de caso sobre o substitutivo
proposto no Brasil, visando aprofundar a compreensão dos desafios da IA. A monografia
busca avaliar as implicações da IA na eficácia do direito à privacidade, examinando o impacto
desta tecnologia sobre a privacidade dos usuários na internet e as propostas legislativas em
tramitação. Concluiu-se que se torna de suma importância incluir avaliações de impacto de
privacidade nas leis e desenvolver legislação que atenda especificamente aos desafios da IA,
com ênfase em ética, transparência e responsabilidade. Defende-se uma regulamentação
adaptada aos riscos das diferentes aplicações de IA para uma governança eficaz. Assim,
observou-se que um marco regulatório robusto e adaptável é crucial para mitigar riscos e
promover um ambiente digital seguro e um desenvolvimento tecnológico que respeite os
direitos fundamentais, especialmente a privacidade.
