dc.description.abstract | The subject related to privacy and data protection have undergone significant changes with advances in technology. Among the main consequences that can be observed from the phenomenon of the digitization of the world, the mitigation between the limits between the public and private spheres stands out, forcing the concept of privacy to be reinvented. In the context of these new social needs, the right to informational self
determination develops, which becomes effective when the holder gains knowledge and influence over the collection and processing of his personal data. The debate gains greater importance with the entry into force of the General Data Protection Law (LGPD). However, this prerogative is still frequently violated, which attracts the possibility of civil liability for the violation of informative self-determination, which is an unfolding of the human personality. Considering that the controversies that discuss the right under analysis, frequently, requires judicial intervention for their resolution, it is important to know the position of the jurisprudence on the subject. Faced with the impossibility of analyzing all the courts that make up the Brazilian Judiciary, the research proposes to carry out a jurisprudential analysis of the Court of Justice of the State of São Paulo (TJ/SP), justifying the selection due to the significant number of res judicata, seeking to answer the following research problem: how does the jurisprudence of the TJ/SP use the institute of civil liability to protect situations of violation of the right to informative self-determination in the light of the LGPD from its validity? As part of broad and general concepts to achieve the objective of identifying the decision-making pattern of the TJ/SP, the research will have a deductive approach method and a monographic procedure method, using bibliographical and documental research as a technique. The analysis demonstrates that the damage resulting from the irregular processing of sensitive personal data is presumed, while that of non-sensitive personal data must be proven. The final considerations are aimed at fostering the debate whether the obligation for proper treatment is a means or a result, as well as questioning whether there is no excessive burden regarding the distribution of the burden of proof to the holder. | eng |

dc.description.resumo | A matéria afeta à privacidade e proteção de dados sofreu grandes modificações com os avanços da tecnologia. Dentre as principais consequências que se pode observar do fenômeno da digitalização do mundo, destaca-se a mitigação entre os limites entre as esferas público e privada obrigando que o conceito de privacidade fosse reinventado. No cenário destas novas necessidades sociais, desenvolve-se o direito à autodeterminação informativa, que se efetiva quando o titular passa a ter conhecimento e influência sobre a coleta e tratamento de seus dados pessoais. O debate ganha maior importância com a entrada em vigor da Lei Geral de Proteção de Dados (LGPD). Contudo, tal prerrogativa ainda é frequentemente violada, o que atrai a possibilidade de reparação civil pela violação da autodeterminação informativa, que é um desdobramento da personalidade humana. Considerando que as controvérsias que discorrem sobre o direito em análise, não raro, necessitam de intervenção judicial para o seu deslinde, impende conhecer qual o posicionamento da jurisprudência sobre o tema. Diante da impossibilidade de análise de todos os tribunais integrantes do Poder Judiciário brasileiro, a pesquisa se propõe a fazer uma análise jurisprudencial do Tribunal de Justiça do Estado de São Paulo (TJ/SP), justificando-se o recorte em razão do número significativo de casos julgados, buscando responder ao seguinte problema de pesquisa: de que maneira a jurisprudência do TJ/SP se utiliza do instituto da responsabilidade civil para tutelar situações de violação ao direito de autodeterminação informativa à luz da LGPD a partir de sua vigência? Como parte de conceitos amplos e gerais para alcançar o objetivo de identificar o padrão decisório do TJ/SP, a pesquisa contará com um método de abordagem dedutivo e método de procedimento monográfico, utilizando como técnica de pesquisa a bibliográfica e documental. No que se refere à seleção dos julgados que compõem o corpo de análise da presente pesquisa, no buscador de jurisprudência do TJ/SP, buscou-se no inteiro teor dos documentos julgados através de dois grupos de palavras-chave, quais sejam: A análise demonstra que o dano decorrente do tratamento irregular de dados pessoais sensíveis é presumido, ao passo que o de dados pessoais não sensíveis deve ser comprovado. As considerações finais vão no sentido de fomentar o debate se a obrigação pelo tratamento adequado é de meio ou de resultado, bem como questionar se não há onerosidade excessiva quanto à distribuição do ônus probatório ao titular. | por |
