dc.description.abstract | This study aimed to present some important aspects about the loss of chance theory
and the medical-hospital liability, as well as to verify the Court of Justice of Rio
Grande do Sul (TJRS) understanding of the issue. For that, the medical-hospital
liability appeals judged by the TJRS were analyzed on the basis of the loss of chance
theory. The jurisprudential research returned 63 judged appeals between 1990 and
October 2013. Such appeals provided data for the creation of the graphs presented
in chapter 4, which refer to the application of the loss of chance theory in medicalhospital
liability in the TJRS. Among the results of this jurisprudential research, it was
verified that there was a significant increment in the number of appeals about the
matter from 2007, the majority of them being civil ones. Further, it was found that
hospitals appeared as defendants in most of the actions, which were mainly
proposed as a result of the patient‟s death, disability or limb, sense or function loss.
With regard to the success in the demands after judgment of the appeals, it was
observed that the decisions were mostly in the plaintiffs‟ favor. It can be concluded
that, although the adoption of the loss of chance theory by the Brazilian Judicial
Power is recent, it has brought new outcomes to the notions of civil liability, also
reflecting in the medical-hospital liability. That is because acceptance of the partial
causality has condemned physicians, clinics and hospitals to compensate the
victims, even though it is not possible to be absolutely certain whether the action or
omission was decisive for the damage to occur, or, that the damage would not have
occurred if the defendant‟s conduct had been different. In this context, the lost
chance rather than the damage itself is compensated for through the loss of chance
theory, using the principles of proportionality and reasonability. | eng |

dc.description.resumo | O presente trabalho teve o objetivo de apresentar alguns aspectos importantes
sobre a teoria da perda da chance e a responsabilidade médico-hospitalar, bem
como verificar o entendimento do Tribunal de Justiça do Rio Grande do Sul a
respeito do tema. Para tanto, procedeu-se à análise dos recursos julgados pelo
Tribunal sobre responsabilidade médico-hospitalar à luz da teoria da perda de uma
chance. A pesquisa jurisprudencial retornou 63 recursos julgados no período entre
1990 e outubro de 2013. Estes julgados forneceram subsídios para a elaboração dos
gráficos apresentados no capítulo 4, que trata da aplicação da teoria da perda da
chance à responsabilidade médico-hospitalar no TJRS. Como resultado desta
pesquisa jurisprudencial, verificou-se, entre outros, que a partir de 2007 houve um
incremento significativo no número de recursos sobre o tema, sendo que a maioria
deles foram apelações cíveis. Constatou-se ainda que os hospitais figuraram como
réus na maioria das ações, as quais foram propostas principalmente em função da
morte, invalidez ou perda de membro, sentido ou função dos pacientes. Com relação
ao êxito nas demandas após o julgamento dos recursos, verificou-se que as vítimas
foram as maiores beneficiadas. Conclui-se que, a despeito de o acolhimento da
teoria da perda de uma chance no Poder Judiciário Brasileiro ser recente, já trouxe
novos contornos às noções de responsabilidade civil, com reflexos também na
responsabilidade médico-hospitalar. Isto porque a aceitação da causalidade parcial
tem ensejado a condenação de médicos, clínicas e hospitais a indenizar as vítimas,
ainda que não seja possível ter absoluta certeza de que sua ação ou omissão foram
decisivos para a ocorrência do dano, ou, dito de outro modo, que o dano não
ocorreria caso a conduta do réu fosse diversa. Nesse contexto, através da teoria da
perda de uma chance indeniza-se não o dano em si, mas a chance perdida,
aplicando-se os princípios da proporcionalidade e da razoabilidade. | por |
