dc.description.abstract | This paper seeks to identify the transitional justice models that Argentina (1983) and
Brazil (1984) adopted in their political transition process to democracy, after
overcoming military regimes. From the bibliographical review on the subject of
transitional justice, it was possible to know some concepts, identify various
transitional mechanisms, types of transitions and some models of transitional justice
followed by some States that, during regime transition, had to deal with a legacy of
past abuses. The analysis of the countries under study – Argentina and Brazil –
showed that while the Brazilian transition is largely controlled by the military
government (transition from above); the argentine transition results from the collapse
of the military regime itself (transition by collapse) and the government, despite
attempts, was not able to control the transition. In Argentina there was no
liberalization stage and the transition to democracy was relatively rapid, with a clear
break with the military regime. In Brazil, the process is characterized by slow political
opening (with the relaxation of repression and the gradual reestablishment of basic
civil and political rights); with the transition to democracy being consolidated, in fact,
in the civil government (1985) and with a certain continuity of the military regime.
Between the countries (Argentina and Brazil) there are significant differences in the
political strategies that the democratic governments adopted to deal with the serious
human rights violations perpetrated during the military regimes. The justice
mechanisms adopted at the beginning of Argentina's democracy (investigation
commissions and trials) and during Brazil's political opening (the Amnesty Law)
shape the transitional justice model in each country. While Argentina tended towards
the punitive model (based on criminal accountability); Brazil tended towards the
model of oblivion, based on omission and maintenance of the status quo. With regard
to the different initial political strategies in the cases of Argentina and Brazil, it can be
said that they reflect viable choices, in terms of the balance of power and political
will, at that historical moment; and that these initiatives outlined the respective
models of justice. The cases demonstrate that the rebalancing of forces over time
promotes the redefinition of the model, with new demands for transitional justice. | eng |

dc.description.resumo | O presente trabalho busca identificar os modelos de justiça de transição que a
Argentina (1983) e o Brasil (1984) adotaram no seu processo de transição política
para a democracia, após a superação dos regimes militares. A partir da revisão
bibliográfica sobre a temática da justiça de transição, foi possível conhecer alguns
conceitos, identificar diversos mecanismos transicionais, tipos de transições e alguns
modelos de justiça de transição seguidos por alguns Estados que, na transição de
regime, precisaram lidar com um legado de abusos do passado. A análise dos
países objeto de estudo – Argentina e Brasil – permitiu constatar que, enquanto a
transição brasileira é amplamente controlada pelo governo militar (transição de cima
para baixo); a transição argentina resulta do colapso do próprio regime militar
(transição por colapso) e o governo, apesar das tentativas, não foi capaz de
controlar a transição. Na Argentina não houve etapa de liberalização e a transição
para a democracia foi relativamente rápida, com clara ruptura com o regime militar.
No Brasil, o processo é caracterizado por lenta abertura política (com o
abrandamento na repressão e o restabelecimento gradual de direitos civis e políticos
básicos); sendo que a transição para a democracia se consolida, de fato, no governo
civil (1985) e com certa continuidade do regime militar. Entre os países (Argentina e
Brasil) existem significativas diferenças nas estratégias políticas que os governos
democráticos adotaram para lidar com as graves violações dos direitos humanos
perpetrados durante os regimes militares. Os mecanismos de justiça adotados no
início da democracia Argentina (comissão de investigação e julgamentos) e na
abertura política brasileira (a Lei de Anistia) formatam o modelo de justiça de
transição em cada país. Enquanto a Argentina tendeu ao modelo punitivo (fundado
na responsabilização penal); o Brasil tendeu ao modelo do esquecimento, fundado
na omissão e na manutenção do status quo. No que diz às diferentes estratégias
políticas iniciais nos casos da Argentina e do Brasil, pode-se dizer que elas refletem
escolhas viáveis, em termos de equilíbrio de poder e de vontade política, naquele
momento histórico; e que tais iniciativas delinearam os respectivos modelos de
justiça. Os casos demonstram que o reequilíbrio de forças no decurso do tempo
promove a redefinição do modelo, com novas demandas da justiça de transição. | por |
