Lei de acesso à informação pública: análise jurídica e opinião dos servidores públicos
Abstract
A Lei de Acesso à Informação (Lei nº 12.527/2011), que entrou em vigor no ano de 2012, ampliou a transparência dos órgãos públicos. Por permitir a divulgação das remunerações nominais dos servidores públicos, causou muita discussão no meio jurídico. Assim, o objetivo deste estudo consistiu em analisar como esta legislação está sendo tratada pela doutrina e jurisprudência, bem como avaliar a opinião dos Servidores Públicos em relação à mesma. Para isso, este estudo foi desenvolvido em duas etapas. A primeira consistiu em, a partir de uma ampla pesquisa bibliográfica, conhecer como está se concretizando a transparência na Administração Pública, especialmente no Poder Executivo do Estado do Rio Grande do Sul. A partir dessa, percebeu-se que a doutrina e jurisprudência têm pontos de vista muito divergentes; porém, as opiniões em geral convergem para a possibilidade de divulgação. A segunda etapa consistiu em uma pesquisa junto aos Servidores Públicos de órgãos estaduais, avaliando seu conhecimento sobre a LAI, bem como o impacto da mesma em suas vidas. O resultado desta pesquisa mostrou que aqueles servidores cuja remuneração é divulgada concordam com isso e não se sentem prejudicados; aqueles cujas informações são sigilosas temem essa divulgação. Ou seja, a LAI não afetou negativamente aqueles que sofrem seu impacto direto.
