Análise de alienação parental: um ato de violência aos menores
Abstract
A Síndrome de alienação Parental é um transtorno psicológico onde o genitor alienador, transforma a consciência de seus filhos, com o objetivo de impedir ou destruir seus vínculos com o outro genitor alienado, e a mesma está se tornando um dos grandes problemas sociais que cresce a cada ano, conforme dados estatísticos realizados pela Associação de Pais e Mães Separados (APASE). Denota-se atualmente que a separação é desgastante para ambos os genitores e principalmente para os filhos que acabam convivendo com situações de angústias, mágoas, ressentimentos. Os pais “jogam os filhos” um contra o outro, deixando as cabecinhas, dos mesmos, perturbadas. A fim de evitar tais conflitos, em 26/08/2010 foi publicada a Lei de Alienação Parental visando à proteção dos menores desse mal que ameaça toda sociedade, bem como defendendo o direito do alienado que também sofre com essa discriminação. Há doutrinadores que acreditam que a melhor forma de evitar a alienação é concedendo a guarda compartilhada aos pais, que é uma das formas mais equilibradas e evoluídas de manter os vínculos parentais com os filhos após o rompimento da vida conjugal. O presente trabalho tem por objetivo analisar a forma mais adequada para diminuir a Alienação Parental, garantindo as crianças o direito ao desenvolvimento saudável e a participação dos pais na vida dos filhos. Foi realizada uma metodologia bibliográfica com pesquisas em livros, e através desta pesquisa foi alcançada o resultado através da guarda compartilhada e dos programas sociais.
