As funções e cargos em comissão no judiciário federal: do ultrapassado clientelismo à efetiva motivação funcional
Abstract
As Funções Comissionadas e Cargos em Comissão são cargos públicos
previstos em lei, de livre nomeação e exoneração, no Poder Judiciário Federal ocupados em
sua quase totalidade por servidores concursados pertencentes ao quadro permanente.
Pretende-se com este estudo formular uma análise crítica da forma discricionária de acesso às
Funções Comissionadas (FCs) e Cargos em Comissão (CJs) e sua relação com os aspectos
culturais do órgão; com a motivação e a satisfação na carreira judiciária; com a gestão de
pessoas e as relações de poder; com os processos de trabalho e as funções gerenciais; com a
impessoalidade e o interesse público no Estado Democrático de Direito. Analisando os
fenômenos pesquisados, concluímos estar diante de uma sistemática que não privilegia a
motivação e a satisfação funcionais, que reforça relações autoritárias de poder interno,
desrespeita premissas do Estado Democrático de Direito e da Administração Pública e não
contribui para a qualificação funcional na carreira judiciária.
