Preço de transferência: ênfase no método preço de revenda menos o lucro

Os preços de transferência têm por objetivo evitar a remessa indireta de lucros, seja esta por meio do superfaturamento das importações ou da subavaliação das exportações. As condições para tal é que as pessoas envolvidas nesta transação caracterizem-se como vinculadas e estejam localizadas em países diferentes, sem observar o princípio arm’s lenght, o qual orienta que o preço acordado nas operações seja livre de ingerência de umas das partes sobre a outra. Para evitar que o Estado seja lesado, em qualquer uma das vias de operação com o exterior, a legislação brasileira determinou metodologias de cálculo para apuração do preço parâmetro que servirá de base para comparação e determinação do valor do ajuste, sempre que este aplicável. Embora cada método tenha a sua peculiaridade é no método do preço de revenda menos o lucro 60%, aplicado sobre produtos e serviços utilizados na produção, que residem os principais pontos de discussão desde que a IN 243/2002 revogou a IN 32/01 e acabou por majorar, em alguns casos, a base de cálculo para apuração do parâmetro. Desde então este impacto tem sido intensamente debatido, principalmente por parte das empresas que dependem de fornecedor estrangeiro (caracterizado como pessoa vinculada) para continuidade do negócio. À parte disso, o contador que domina os aspectos relacionados a preços de transferência contribui positivamente para a elaboração do planejamento tributário e no desenvolvimento do IX sistema contábil, diminuindo os riscos de infrações fiscais e incrementando o resultado.
