Auditoria no setor de dívida ativa da prefeitura municipal de Santa Maria – um estudo de caso
Abstract
Os municípios têm a função primordial de oferecer condições básicas instituídas em lei para a sua população, tais como saúde, habitação, higiene, saneamento básico dentre outras funções. Para atender essas funções, as prefeituras necessitam de recursos os quais são obtidos através das receitas provenientes de impostos de sua competência como Iptu, Issqn dentre outros. Os contribuintes que não pagam seus impostos são inscritos na Dívida Ativa, ficando o município responsável pela devida cobrança dos seus créditos. Dívida Ativa é a importância relativa a tributos, multas e créditos da Fazenda Pública, lançados, mas não cobrados ou não recebidos no prazo de vencimento, a partir da data de sua inscrição. A Dívida Ativa Tributária é o crédito da Fazenda Pública dessa natureza, proveniente de obrigação legal relativa a tributos e respectivos adicionais e multas e a dívida ativa não tributária são os demais empréstimos compulsórios, as contribuições estabelecidas em lei, as multas de qualquer origem ou natureza, exceto as tributárias, os foros, os laudêmios, os aluguéis ou as taxas de ocupação, as custas processuais, os preços de serviços prestados por estabelecimentos públicos, as indenizações, as reposições, as restituições e outras obrigações legais.
