O processo de tombamento do patrimônio histórico e cultural no município de Alegrete/RS: marco legal, situação atual e soluções existentes para a efetivação da conservação dos bens tombados e sua destinação turística e econômica

Abstract

The purpose of this article is to analyze the policy for preserving the historic and cultural heritage of the municipality of Alegrete, before and after the enactment of municipal law No. 1,487 of August 30, 1982, which instituted the process of heritage listing and inventorying of real estate, the impacts of this law on the interruption of the constant demolition of properties subject to preservation, which was a reality before the beginning of the 1980s, verifying the existence or not of legal mechanisms that allow the maintenance of heritage-listed properties. It is important to emphasize the responsibility of the state in this matter, considering that the protection to historical heritage is provided mainly by the Federal Constitution and the City Statute. The article also aims, through a survey of the precarious current situation of some buildings of relevant historical and cultural value located in the central area of the city of Alegrete, to make a comparison of how other cities in the state of Rio Grande do Sul made recovery, maintenance and tourist and economic destination projects of old real estate, heritage-listed or not, feasible. Through the data obtained from the research, it was demonstrated that the financial resources for restoration and recovery of real estate, heritagelisted or not, can come from different sources, such as investment by free resource, access to judicial deposits, culture incentive law and formalization of partnerships with private initiative.
