O processo de tombamento do patrimônio histórico e cultural no município de Alegrete/RS: marco legal, situação atual e soluções existentes para a efetivação da conservação dos bens tombados e sua destinação turística e econômica
Abstract
O objetivo deste artigo é analisar a política de preservação do patrimônio histórico e cultural
do município de Alegrete, antes e depois da promulgação da Lei Municipal nº 1.487, de 30 de
agosto de 1982, que instituiu o processo de tombamento e arrolamento de bens imóveis, os
impactos desta lei na interrupção da constante demolição de imóveis passíveis de preservação,
que era realidade antes do início da década de 1980, verificando-se a existência ou não de
mecanismos legais que permitam a manutenção dos bens tombados. Enfatiza-se a
responsabilidade do poder público neste tema, considerando-se a previsão de proteção ao
patrimônio histórico trazida, principalmente, pela Constituição Federal e Estatuto da Cidade.
O artigo visa também, por meio de um levantamento da precária situação atual de alguns
prédios de relevante valor histórico e cultural localizados na área central da cidade de
Alegrete, fazer um comparativo de como outras cidades do Estado do Rio Grande do Sul
viabilizaram projetos de recuperação, manutenção e destinação turística e econômica de bens
imóveis antigos tombados ou não. Através dos dados obtidos com a pesquisa, demonstrou-se
que os recursos financeiros para restauração e recuperação de imóveis tombados ou não
podem vir de fontes diversas, como investimento por recurso livre, acesso a depósitos
judiciais, lei de incentivo à cultura e formalização de parcerias com a iniciativa privada.
