dc.description.abstract | “Life cannot be evaluated based on the past, but through deeds, through continuity” (MINISTER CARMEN LUCIA). This statement shows how important freedom of speech is. The need to guarantee freedom of speech made its insertion possible in Brazilian law through the Federal Constitution (1988) and the Civil Code (2002). The right to freedom of speech emerged during the polemic of non-authorized biographies (2013 to 2015), which generated the full judgment text of the Direct Unconstitutionality Action (ADI) 4.815. Thus, the aim of this thesis is analyzing the dimension of legal discourse to elucidate the contribution of modality to the elaboration of argumentation and to the realization of sociosemiotic processes that constitute a full judgment text. For the discursive-semantic analysis, this study is theoretically based on Haberma’s (1997) Discourse Theory of Law, by exposing how processes that generate deliberation are built. It is also based on Toulmin’s (2006) approach in regards to the uses of argument and the configuration of sociosemiotic processes (MATTHIESSEN, 2015) in the development of the full judgment text. The grammatical description is based on Systemic Functional Linguistics (HALLIDAY; MATTHIESSEN, 2014) that, besides Register Cartography (MATTHIESSEN, 2015), adopts modality as a determinant of the different degrees of commitment of speakers in their discourse. The methodological procedures, which are qualitative and quantitative, allowed us to determine the relationship between legal discourse, argumentation, social activity, and register. As a result, there is the composition of the full judgment text in fourteen main social activities, which are constituted by three primary sociosemiotic processes, which are Expounding, Enabling and Exploring, being the latter the one that most occurs. Similarly, in regards to argumentation, various compositions of the use of arguments of both the reporting justice and institutions/authorities and ministers in each social activity were identified. Among the sociosemiotic processes, Expounding could be considered as having power and commitment through modality, by explaining and categorizing opinion; Enabling, although presenting a lower number of modality occurrences, meets the requirement of legitimation of legal, constitutional precepts, and Exploring uses modality as a way to argument and review past facts. | eng |

dc.description.resumo | “A vida não pode ser avaliada com base no passado, mas pelas obras, pela continuidade” (MINISTRA CÁRMEN LÚCIA). Essa afirmação demonstra o quanto o tema liberdade de expressão é importante. A necessidade de se garantir a liberdade de expressão possibilitou a sua inserção na legislação brasileira por meio da Constituição Federal (BRASIL, 1988) e do Código Civil (BRASIL, 2002). O direito à liberdade de expressão veio à tona com a polêmica das biografias não autorizadas (2013 a 2015), dando origem ao Inteiro Teor de Acórdão da ADI 4.815. Sendo assim, o objetivo geral desta tese é analisar a dimensão do discurso jurídico com vistas a elucidar a contribuição do uso da modalidade para a elaboração da argumentação e para a realização dos processos sociossemióticos que compõem um Inteiro Teor do Acórdão. Para a análise semântico-discursiva, este estudo tem embasamento teórico na teoria discursiva do Direito (HABERMAS, 1997), ao expor de que forma se constroem processos que originam a deliberação, e na abordagem de Toulmin (2006), no que se refere aos usos dos argumentos e na configuração dos processos sociossemióticos (MATTHIESSEN, 2015) no desenvolvimento do Inteiro Teor de um Acórdão. Já a descrição gramatical assenta-se na Linguística Sistêmico-Funcional (HALLIDAY; MATTHIESSEN, 2014) que, além da Cartografia de Registro (MATTHIESSEN, 2015), adota a modalidade como determinante dos diferentes graus de comprometimento dos oradores em seus discursos. Os procedimentos metodológicos, de cunho qualitativo e quantitativo, permitiram determinar a relação entre discurso jurídico, argumentação, atividades sociais e registro. Como resultados, destaca-se a composição do Inteiro Teor de Acórdão em quatorze atividades sociais principais, compostas por três processos sociossemióticos primários, a saber: Expor, Possibilitar e Explorar, este o de maior ocorrência em todo o Acórdão. Da mesma forma, no que se refere à argumentação, foram identificadas diversas composições dos usos dos argumentos em cada atividade social, tanto da Ministra Relatora como das Instituições/Autoridades e dos Ministros. Dentre os processos sociossemióticos, Expor pode ser considerado o detentor do poder e do compromisso por meio da modalidade, ao explanar e categorizar a opinião; Possibilitar, apesar de apresentar modalidade em menor número, cumpre papel de legitimação dos preceitos jurídicos constitucionais; e Explorar emprega a modalidade como forma de argumentar e rever fatos passados. | por |
