dc.description.abstract | This monograph aims to investigate the impact of the illegal enslavement of free
people across the western border of Rio Grande de São Pedro and the neighboring Estado
Oriental. Through the analysis of the trajectory of the 'preta menor' Faustina, the goal is to
problematize issues such as the influence of the abolitionist laws of Estado Oriental on the
attainment of freedom in cases of illegal enslavement, specifically those of 1842 and,
primarily, the one promulgated in 1846 by the government of Cerrito. Similarly, the Brazilian
legislation will be problematized and discussed, including the Criminal Code of 1830 with its
Article 179 specifically addressing the issue of illegal enslavement, as well as the treaties
between the Brazilian Empire and Estado Oriental in 1851. Another point of interest is the
historiographic debate on the understanding of borders and how they were utilized or
managed in warlike contexts as a strategy for escape, the pursuit of freedom, and as a cause of
conflicts between neighboring territories. The guiding source of the research is the criminal
process initiated in 1852, which involves the minor Faustina as the victim, illegally reduced to
slavery by Manoel Marques Noronha and Maria Duarte Nobre. This rich document presents a
scenario of war conflicts and razias. In order to support the research hypotheses,
historiographic productions on slavery in the southern border of the Empire will be utilized,
along with discussions on the existing legislation. | eng |

dc.description.resumo | Esta monografia tem como principal objetivo investigar a questão da escravização
ilegal de pessoas livres através da fronteira oeste do Rio Grande de São Pedro e o vizinho
Estado Oriental. A partir da análise da trajetória da “preta menor” Faustina pretende-se
problematizar questões como a influência das leis abolicionistas do Estado Oriental na
conquista da liberdade em casos de escravização ilegal, sendo elas as de 1842 e,
principalmente a promulgada no ano de 1846 pelo governo de Cerrito. Da mesma forma, será
problematizada e debatida a legislação brasileira, como o Código Criminal de 1830 com seu
Artigo 179 que versava especificamente sobre a questão da escravização ilegal, e os tratados
entre o Império Brasileiro e o Estado Oriental de 1851. Outro ponto de interesse é o debate
historiográfico sobre o entendimento de fronteira e como ela foi utilizada, ou manejada, em
contextos bélicos como estratégia de fuga, conquista de liberdade e como agente causador de
conflitos entre territórios vizinhos. A fonte norteadora da pesquisa é o processo-crime iniciado
em 1852, que tem como vítima a menor Faustina, que foi ilegalmente reduzida à escravidão
por Manoel Marques Noronha e Maria Duarte Nobre, sendo este um rico documento que
apresenta uma conjuntura de conflitos bélicos e de razias. A fim de sustentar as hipóteses de
pesquisa serão utilizadas produções historiográficas sobre a escravidão na fronteira sul do
império, além de debates a respeito da legislação vigente. | por |
