dc.description.abstract | This study aims, through literature review and documentary analysis, to identify how the
international law on female reproductive rights is institutionally linked in Brazil and how this
chain affects the promotion and protection of these rights. Thus, understanding the centrality
of reproductive rights to women's human rights and the capacity and necessity of international
law to effectively implement, through public policies, these human rights, we sought to
analyze the relationships between these three elements (international law, public policies and
implementation). The verified hypothesis was that, despite the ability of international law to
strengthen domestic institutions, reinforce national governance and compel domestic action,
the impact of international law on the implementation of female reproductive rights in Brazil
is limited by the country's social and cultural structure. Regarding the relationship between
international law and local public policies on reproductive rights, the work argues that it
occurs through the influence of international law on the creation of laws, which, in turn,
enable and require the creation of public policies so that they are implemented and enforced.
This relationship, however, is not the only one that exists between these two components.
There is also a direct relationship with the influence of the “international” on public policies,
even in cases where the laws that govern the formulation of local public policies do not have
direct mention of the international, since they are the ones that have the ultimate function of
enforcing human rights. Regarding the relationship between international law and the
implementation of public policies, the work argues that, although the action of international
law in domestic institutions is verified in order to strengthen domestic institutions, subsidize
domestic political groups and compel the action of institutions, this action does not is
sufficient to guarantee the domestic effectiveness of public policies. This happens because,
despite there being a strong international influence, Brazil's conservative structure is rooted in
society, meaning that political will prevails in discourses that control women's choices and are
contrary to the expansion and implementation of reproductive rights provided for in

dc.description.resumo | Este trabalho tem o objetivo de, por meio da revisão da literatura e da análise documental,
identificar de que forma o direito internacional dos direitos reprodutivos femininos é
institucionalmente encadeado no Brasil e como esse encadeamento afeta a promoção e a tutela
desses direitos. Dessa forma, compreendendo a centralidade dos direitos reprodutivos para os
direitos humanos das mulheres e a capacidade e o compromisso do direito internacional de
implementar efetivamente, por meio das políticas públicas, esses direitos humanos, buscou
analisar as relações entre esses três elementos (direito internacional, políticas públicas e
implementação). A hipótese verificada foi a de que, apesar da capacidade do direito
internacional de fortalecer instituições domésticas, reforçar a governança nacional e compelir
ação doméstica, o impacto do direito internacional na implementação dos direitos
reprodutivos femininos no Brasil é limitado pela estrutura social e cultural do país. Quanto à
relação entre direito internacional e políticas públicas locais de direitos reprodutivos, o
trabalho argumenta que ela se dá por meio da influência do direito internacional na criação de
leis, que, por sua vez, possibilitam e exigem a criação de políticas públicas para que sejam
implementadas e efetivadas. Essa relação, porém, não é a única que se dá entre esses dois
componentes. Existe também a relação direta da influência do “internacional” nas políticas
públicas, mesmo em casos em que as leis que regem a formulação das políticas públicas
locais não tenham menções diretas ao internacional, já que são elas que possuem a função
final de efetivar os direitos humanos. Quanto à relação entre direito internacional e
implementação de políticas públicas, o trabalho argumenta que, apesar de ser verificada a
ação do direito internacional nas instituições domésticas no sentido de fortalecer instituições
domésticas, subsidiar grupos políticos domésticos e compelir a ação das instituições, essa
ação não é suficiente para garantir a efetividade doméstica das políticas públicas. Isso
acontece porque, apesar de existir uma forte influência internacional, a estrutura conservadora
do Brasil é enraizada na sociedade, fazendo com que na vontade política prevaleçam os
discursos de controle das escolhas femininas e contrários ao alargamento e efetivação dos
direitos reprodutivos previstos nos mecanismos internacionais. | por |
