dc.description.abstract | This work aims to investigate whether Japan's accountability strategies for the remaining survivors of the military sexual slavery system were sufficient to repair the victims based on the International Law of Recognition in order to answer the question: is it possible to repair History? Initially, it is assumed that the victims were not compensated, nor is the State responsible in accordance with the forms of reparation requested by the survivors. In this sense, the present work begins with the analysis of the case at the intersection of feminism, social classes and nationalism, in addition to presenting Emmanuelle Jouannet's International Law of Recognition, the theoretical framework of the present research, in order to understand how it occurred historically the ''comfort'' system. The second part, in turn, addresses human rights violations that occurred within the system of military sexual slavery in accordance with the articles of the Universal Declaration of Human Rights, as well as investigating which actors sought to hold the State of Japan accountable for crimes committed against the victims of the ''comfort'' system and in what ways such reparation can occur according to the International Law of Recognition. Finally, Japan's accountability strategies at the domestic level of the Japanese country and the South Korean country and at the international level are presented in the third part of the work in order to understand whether the forms of reparation occurred spontaneously or not. Therefore, the research is qualitative, as it seeks to describe, interpret and analyze the entire “Comfort Women” case in order to understand its functioning, its causes and the accountability methods that can or were used to resolve the issue. To this end, the methodology used is the case study, in a deductive way, in which it goes from the general argument to the specific, and the method used was the specialized bibliographic review and the analysis of documents and recognized media vehicles. The results of the investigation suggest that Japan's strategies to take responsibility, even though there were some attempts to resolve the case, were insufficient to meet the survivors' desires for recognition. | eng |

dc.description.resumo | Este trabalho tem por objetivo averiguar se as estratégias de responsabilização do Japão para as sobreviventes remanescentes do sistema de escravidão sexual militar foram suficientes para reparar as vítimas com base no Direito Internacional do Reconhecimento em prol de responder o questionamento: é possível reparar a História? De início, parte-se da hipótese de que as vítimas não foram recompensadas, tampouco o Estado se responsabiliza de acordo com as formas de reparação pedidas pelas sobreviventes. Nesse sentido, o presente trabalho começa com a análise do caso sob a interseção do feminismo, das classes sociais e do nacionalismo, além de apresentar o Direito Internacional do Reconhecimento de Emmanuelle Jouannet, marco teórico da presente pesquisa, a fim de entender como ocorreu historicamente o sistema de ‘’conforto’’. A segunda parte, por sua vez, aborda as violações de direitos humanos ocorridas dentro do sistema de escravidão sexual militar de acordo com os artigos da Declaração Universal dos Direitos Humanos, bem como investiga quais atores buscaram a responsabilização do Estado do Japão pelos crimes cometidos contra as vítimas do sistema de ‘’conforto’’ e em quais formas tal reparação pode acontecer segundo o Direito Internacional do Reconhecimento. Por fim, as estratégias de responsabilização do Japão no âmbito doméstico do país nipônico e do país sul-coreano e no âmbito internacional são apresentadas na terceira parte do trabalho a fim de entender se as formas de reparação ocorreram de forma espontânea ou não. Dessa forma, a pesquisa é qualitativa, pois busca descrever, interpretar e analisar todo o caso ‘’Mulheres de Conforto’’ em prol de entender o seu funcionamento, suas causas e os métodos de responsabilização que podem ou foram utilizados para resolver a questão. Para tanto, a metodologia utilizada é o estudo de caso, de forma dedutiva, na qual parte do argumento geral para o específico, e o método usado foi a revisão bibliográfica especializada e a análise de documentos e de veículos midiáticos reconhecidos. Os resultados da investigação sugerem que as estratégias do Japão para se responsabilizar, mesmo que tenham existido algumas tentativas de resolver o caso, foram insuficientes para atender aos desejos de reconhecimento das sobreviventes. | por |
