dc.description.abstract | Approximately from the 60s, Brazil underwent a strong appreciation of the city in relation to the field. It can be observed that from that time there was a growing rural exodus, but it is only around 70 the number of people living in cities exceeds the population of the field. This increase in population group in urban centers enabled the fortification of social movements3 which preached the improvement of life, among these, one can highlight the struggles for housing, in which one of its guidelines was / is the search of the city's social function in urban centers. In this scenario, the social pressure went on to win two important laws4: the inclusion of a constitutional chapter on urban policy and the advent of the City Statute. Currently, even after the advent of these pro-housing legislation and pro-social function, we follow daily struggles for decent housing and anti-idle real estate. This shows that innovative institutions that brought these systems are presented as important solutions to these problems inherent in the process of formation of cities. So, in view of the contemporary this issue, this paper will focus on the successive constitutional mechanisms of public intervention on private property in order to induce the use of real estate unused or under-utilized for the social function of the city is made possible. Still, it will be analyzed the tools of land tenure existing in the Federal Constitution and the Statute of the City. With this research can be seen that these mechanisms, both land regularization, as those of public intervention in private property, still have much importance in the Brazilian context and that it is up to society through social movements, seeking the full realization of these tools. | eng |

dc.description.resumo | Aproximadamente a partir da década de 60, o Brasil passou por uma forte valorização da
cidade em relação ao campo. Podendo-se observar que a partir dessa época houve um
crescente êxodo rural, mas é somente por volta dos anos 70 que o número de pessoas vivendo
nas cidades supera a população do campo. Esse aumento do contingente populacional nos
centros urbanos possibilitou a fortificação dos movimentos sociais os quais pregavam a
melhoria de vida, dentre esses, pode-se destacar as lutas pela moradia1, em que uma de suas
pautas era/é a busca da função social da cidade nos centros urbanos. Neste cenário, a pressão
social acabou conquistando duas positivações2 importantíssimas: a inclusão de um capítulo
constitucional referente a política urbana e o advento do Estatuto da Cidade. Atualmente,
mesmo após ao advento dessas legislações pró-moradia e pró-função social, acompanhamos
diariamente lutas pela moradia digna e combate à imóveis ociosos. Isso mostra que os
institutos inovadores que esses ordenamentos trouxeram ainda se apresentam como
importantes soluções para esses problemas inerentes ao processo de formação das cidades.
Então, tendo em vista a contemporaneidade desse assunto, esse trabalho dará enfoque aos
sucessivos mecanismos constitucionais de intervenção pública na propriedade privada a fim
de induzir o uso de imóveis não utilizados ou sub-utilizados para que a função social da
cidade seja viabilizada. Ainda, será analisado as ferramentas de regularização fundiária
existentes na Constituição Federal e no Estatuto da Cidade que objetivam consalidar uma das
facetas do direito à moradia, qual seja, a segurança da posse. Com a presente pesquisa pode-se
observar que esses mecanismos, tanto os de regularização fundiária, quanto aqueles de
intervenção pública na propriedade particular, possuem ainda muita importância no cenário
brasileiro e que cabe a sociedade, através dos movimentos sociais, buscar a plena efetividade
dessas ferramentas. | por |
