Lei de acesso à informação: análise das solicitações no município de Santo Ângelo
Abstract
O presente trabalho analisa a Lei nº 12.527 de 18 de novembro de 2011, denominada Lei de Acesso à Informação, criada com o objetivo de regulamentar o direito de acesso à informação, previsto no artigo 5º, XXXIII, da Constituição Federal. Tal conduta gera uma colisão entre dois direitos fundamentais previstos na Constituição Federal: o direito à informação, previsto no artigo 5º, XXXIII, e o direito à proteção da intimidade, vida privada, honra e imagem, previsto no inciso X do mesmo dispositivo. Com base nesta discussão, o trabalho tem como objetivos: (i) examinar a Lei de Acesso à Informação nº. 12.527 de 2011 e o artigo 5º da Constituição Federal de 1988, buscando a fundamentação teórica sobre ambos os temas visando entender o conflito gerado, e (ii) analisar as informações referentes à Lei de Acesso à Informação no município de Santo Ângelo no período de maio de 2012 a maio de 2014 Para atingir este objetivo, foi aplicado na Prefeitura Municipal questionário semiestruturado, utilizou-se pesquisas dos tipos descritivas e explicativas. Os resultados permitiram observar que, no ano de 2012, houve a maior demanda por solicitações, sendo que a maioria foi realizada pelo site da Prefeitura. As secretarias que receberam maiores questionamentos foram a de Administração, a Geral, a de Habitação, a da Fazenda, a de Obras e a do Turismo.
