O uso indevido dos espaços públicos: estacionamentos privativos em calçadas e passeios de uso comum
Abstract
O presente artigo tem como objetivo apresentar um estudo sobre uma prática recorrentemente
observada em grande parte dos municípios brasileiros, que é a conduta de alguns proprietários
de imóveis comerciais destinarem estacionamentos para uso exclusivos para seus clientes em
calçadas e vias públicas, privilegiando-os em detrimento do cidadão pedestre, ocasionando,
com isso, o desvio da destinação natural das calçadas e passeios para o livre trânsito de
pedestres, lesando o cidadão que anda a pé, prejudicando o seu direito de ir e vir,
principalmente os deficientes físicos, idosos e crianças. Através de uma pesquisa
bibliográfica, pesquisou-se como se dá o uso indevido dos espaços públicos, notadamente os
espaços privativos em calçadas e passeios de lugar comum que dificultam a livre locomoção
dos pedestres, averiguando como a legislação em nível nacional e local de algumas cidades
prevê a correta ocupação do espaço pelos pedestres. Concluiu-se que o espaço público das
cidades precisa ser urgentemente pensado, não somente para o trânsito de veículos e sim para
interesse público, de maneira racional, visando o interesse de todos, motoristas e pedestres.
