dc.description.abstract | This monograph addresses the eroticization of children's artists by the media in the
face of comprehensive child protection. The right to full childhood is guaranteed,
with absolute priority, by Article 227 et seq. of the Constitution, as well as by Law
No. 8,069/1990, which provide for the duty of the State, society and the family to
ensure children and adolescents access to health, food, education, leisure, culture,
freedom and dignity, so that they can achieve their full development. In this sense,
children are also guaranteed the exercise of professional artistic activity, under the
terms of Article 8 of Convention No. 138 of the International Labor Organization,
regardless of their age group. Likewise, the mass media is guaranteed the free
exercise of the press, and censorship by the State is prohibited, provided that there
is no offense to the provisions of CF/88, under the terms of Article 5, item IV and IX;
as well as Articles 220 to 224, all of the Constitution. Thus, the discussion deals with
the possible violation of the right of child viewers. From the above, the question is
asked: How can the eroticization of children's artists, promoted by the media,
generate a violation of the fundamental right to full childhood of children? The
objective of this study is to verify, through the analysis of the specific case of the
presenter Maisa Silva, whether the promotion of early eroticization of child artists
violates the fundamental right provided for the childhood of child viewers. The
hypothetical-deductive approach method and the comparative and monographic
procedure methods are used, in addition to the documentary and bibliographic
research technique, as well as the case study technique. The work is divided into
two chapters. The first addresses the full protection of the child against the rise of
the media. The second deals with the regulation of child labor in the face of
eroticization of child artists and, finally, about the reflexes caused to child viewers. It
is concluded that, although freedom of expression and press is guaranteed to the
media, there must be a mitigation of these rights in order to guarantee the protection
of children. Thus, it was demonstrated that the eroticization of child artists hurts the
rights of child viewers, since it encourages them to anticipate the end of childhood,
causing numerous negative consequences, such as, for example, their exposure to
sexual exploitation on the internet. | eng |

dc.description.resumo | A presente monografia aborda a erotização de artistas infantis pelos meios de
comunicação frente à proteção integral à infância. O direito à infância plena é
garantido, com prioridade absoluta, pelo artigo 227 e seguintes da Constituição, bem
como pela Lei n.º 8.069/1990, que dispõem sobre o dever do Estado, da sociedade e
da família em assegurar à criança e ao adolescente o acesso à saúde, alimentação,
educação, lazer, cultura, liberdade e dignidade, a fim de que possam alcançar o seu
desenvolvimento pleno. Nesta senda, também é garantido ao infante o exercício de
atividade profissional artística, nos termos do artigo 8º da Convenção n.º 138 da
Organização Internacional do Trabalho, independente de sua faixa etária. De igual
forma, é garantido aos meios de comunicação em massa o livre exercício de
imprensa, sendo vedada a censura, por parte do Estado, desde que não ocorra
ofensa ao previsto na CF/88, nos termos do artigo 5, inciso IV e IX; bem como dos
artigos 220 a 224, todos da Constituição. Assim, a discussão versa sobre a possível
violação do direito dos telespectadores mirins. Do exposto, questiona-se: De que
forma a erotização de artistas infantis, promovida pelos meios de comunicação,
pode gerar violação ao direito fundamental à infância plena do público infantil? O
objetivo deste estudo é verificar, através da análise do caso concreto da
apresentadora Maisa Silva, se a promoção de erotização precoce de artistas infantis
viola o direito fundamental previsto à infância dos telespectadores infantis. Utiliza-se
o método de abordagem hipotético-dedutivo e os métodos de procedimento
comparativo e monográfico, além da técnica de pesquisa documental e bibliográfica,
bem como a técnica de estudo de caso. O trabalho se divide em dois capítulos. O
primeiro aborda a proteção integral da criança frente a ascensão dos meios de
comunicação. O segundo trata da regulamentação do trabalho infantil frente a
erotização de artistas mirins e, por fim, acerca dos reflexos causados aos
telespectadores mirins. Conclui-se que, embora a liberdade de expressão e de
imprensa seja garantida aos meios de comunicação, deve-se haver uma mitigação
desses direitos, a fim de garantir a proteção aos infantes. Destarte, restou
demonstrado que a erotização de artistas infantis fere o direito dos telespectadores
mirins, uma vez que os impulsiona a antecipar o fim da infância, causando inúmeras
consequências negativas, como, por exemplo, a exposição destes à exploração
