dc.description.abstract | Inspired by the rule of law emerged after the period of military dictatorship, the 1988 constituent spared no kind words to write the Federal Constitution. The political landscape was polarized due to the Cold War, so the economic possibilities were restricted to only two regimes: the defense of individual rights or the adoption of social policies. The Brazilian Constitution chose to focus on this last model, and as a result, the current text distributes warranties, endowed with the noblest sense of philanthropy, giving a large amount of rights to all classes and to all people without distinction. It is commonly called "Citizen Constitution", due to the notorious preoccupation with social causes. The sixth article of the Constitution is the fundamental core of second generation rights: "Art. 6 The social rights are education, health, food, work, housing, leisure, security, social security, protection of motherhood and childhood, and assistance to the destitute‖. However, over the years, it became clear that it would not be so easy to put into practice the constitutional provisions. The same constituent that boasts intentions, dispenses results. Perhaps due to the rigid separation of powers, just like the theory advocated by Montesquieu; perhaps due to the lack of political education of the legislature. Based on these, we have, inevitably, a few questions: Does the compulsory positivation of rights, as it happened in the "Citizen Constitution" is the best way to develop the society and the economy? What is best for the state: the Constitution that discusses about many topics, or one that restricts the important things? These are the questions that this final paper attempts to answer. It concludes the need for flexibility of any extremist regimes, due to the analysis of case studies of global scenario. Still, it is evident that the interventionist inaugurated by the Constitution of 1988 does not provide good prospects when it comes to the possibilities of economic development of Brazil. | eng |

dc.description.resumo | Inspirado pelo Estado Democrático de Direito emergente após o período da ditadura militar, o
constituinte de 1988 não poupou palavras benévolas ao redigir a atual Constituição Federal. O
cenário político mundial, polarizado em virtude da Guerra Fria, restringia as possibilidades
econômicas a apenas dois regimes; o apreço pelos direitos individuais ou a adoção de
políticas sociais. A Carta Magna brasileira optou por focar neste último modelo, e, como
consequência disso, o texto vigente distribui garantias, dotadas do mais nobre sentimento de
filantropia, conferindo os mais variados direitos a todas as classes e a todas as pessoas, sem
distinção. É o que se convencionou chamar de ―Constituição Cidadã‖, pela notória
preocupação com as causas sociais. O artigo sexto da Carta Magna é o núcleo dos direitos
fundamentais de segunda geração: ―Art. 6º São direitos sociais a educação, a saúde, a
alimentação, o trabalho, a moradia, o lazer, a segurança, a previdência social, a proteção à
maternidade e à infância, a assistência aos desamparados, na forma desta Constituição‖.
Entretanto, com o passar dos anos, ficou claro que não seria tão fácil colocar as disposições
constitucionais em prática. O mesmo constituinte que alardeia intenções, dispensa resultados.
Talvez pela rígida separação de poderes, conforme a teoria preconizada por Montesquieu;
talvez pela falta de instrução política do legislador. Frente ao exposto, surgem,
inevitavelmente, algumas perguntas: será que a positivação compulsória de direitos, em uma
―Constituição Cidadã‖, é a melhor forma de desenvolver a sociedade e a economia do país? O
que é melhor para o Estado: a Constituição que delibera sobre muitos temas, ou aquela que se
restringe ao fundamental? São essas as perguntas que o presente trabalho intenta responder.
Conclui-se pela necessidade de flexibilização de eventuais regimes extremistas, em virtude da
análise de casos práticos do cenário global. Ainda assim, fica evidente que a tendência
intervencionista, inaugurada pela Constituição de 1988, não traz boas perspectivas no que se
refere às possibilidades de desenvolvimento econômico do Brasil. | por |
