dc.description.abstract | The Law 13.254/16 established the Special Regime of Foreign Exchange and Tax
Regularization (RERCT), which offered the possibility of regularization of riches,
assets and rights that were abroad without declaration for the tax authorities for
residents or domiciled in Brazil on 31 December 2014, who have been or still were
owners or holders on that date, by paying income tax at the rate of 15% and a fine of
100% on the tax calculated, totaling a 30% tax on the amount to be regularized.
Despite the apparent collection objective, the Act is part of a new global legal
framework for collaboration, where states and financial institutions are exchanging
information more intensively and more frequently, and the chances of discovering
resources kept irregularly abroad are increasing. Thus, this monograph analyzes the
risks and benefits brought by the Law 13.254/16, known as the "Repatriation Law",
under the analysis of this context of international legal cooperation that has arisen,
using a deductive approach and a method of procedure, from the analysis of
legislation and doctrine, since the jurisprudence is still incipient. It was concluded
that, despite the high cost of regularization compared to other countries that have
similar laws and the controversial aspects involved and not fully clarified, adherence
to the Foreign Exchange and Tax Regulation Regime is the best choice for the
taxpayer who fits on the requirements, due to the improvement of the exchange of

dc.description.resumo | A Lei nº 13.254/16 instituiu o Regime Especial de Regularização Cambial e
Tributária (RERCT), que ofertou a possibilidade de regularização de bens, ativos e
direitos que se encontravam no exterior sem declaração perante o fisco para os
residentes ou domiciliados no Brasil em 31 de dezembro de 2014, que tenham sido
ou ainda fossem proprietários ou titulares até essa data, mediante o pagamento de
imposto de renda à alíquota de 15% e multa de 100% sobre o imposto apurado,
totalizando 30% de imposto sobre o montante a ser regularizado. Apesar do
aparente objetivo arrecadatório, a Lei se insere num novo contexto jurídico mundial
de colaboração, em que os Estados e instituições financeiras estão trocando
informações de forma mais intensa e frequente e as chances de que sejam
descobertos os recursos mantidos irregularmente no exterior aumentam. Dessa
forma, a presente monografia analisa os riscos e benefícios trazidos pela Lei nº
13.254/16, conhecida como Lei de “Repatriação”, sob a análise desse contexto de
cooperação jurídica internacional que tem surgido, utilizando um método de
abordagem dedutivo e um método de procedimento monográfico, a partir da análise
da legislação e doutrina, vez que a jurisprudência ainda é incipiente. Concluiu-se
que, apesar do alto custo da regularização em comparação a outros países que
possuíram leis semelhantes e dos aspectos polêmicos envolvidos e não
esclarecidos plenamente, a adesão ao Regime de Regularização Cambial e
Tributária é a melhor escolha para o contribuinte que preenche os requisitos,
justamente pelo aprimoramento da troca de informações entre os Estados. | por |
